UCC implemented in Uttarakhand

Debate in the Constituent Assembly

Let us know that on 23 November 1948, there was a strong debate about UCC in the Constituent Assembly. During this time, some people had the opinion with UCC, while some leaders were opposed to it. At that time, the Muslim League leader and member of the Legislative Assembly Mohammad Ismail Khan started the debate, suggesting the amendment of Article 35 of the draft constitution (which later became Article 44). He had said that this provision should also include that “no group, class or community community will be obliged to give up its personal law, if it has any such law. In fact, Ismail argued that a secular state should not interfere in long -standing religious practices, as it can cause dissatisfaction in the country and spoil harmony.

This leader against UCC?

Apart from Mohammad Ismail Khan, leader of the Muslim League and member of the Assembly, B Poker Sahib Bahadur also opposed it. He had said that if any organization like (Constituent Assembly) intervenes in religious rights and practices, then it will be tortured. Another leader of the Muslim League Naziruddin Ahmed also made a similar proposal.

Dr. BR Ambedkar’s opinion in favor of UCC?

Dr. BR Ambedkar, chairman of the draft committee of the Constitution, was in favor of UCC. He said that it is too late to debate whether the UCC should be implemented or not, because it has already been implemented to a large extent. He said that UCC is already in force in the country, except for selected things like marriage and heritage. Explain that in Article 44 of Indian Constitution of the Constitution of India, it has been said that the state will try to ensure a uniform civil code for citizens all over India. This article was adopted by the Constituent Assembly on 23 November 1948 after a strong debate.
