The Supreme Court has transferred the cases related to violation of market competition rules going on in different courts of the country on e-commerce platforms Amazon and Flipkart to the Karnataka High Court.
The case was heard by a bench of Justice Abhay Oka and Justice Ujjwal Bhuyan. The court said that the subject matter involved in all the petitions is the same on which the bench of Karnataka High Court is hearing.
The Competition Commission of India (CCI) had filed a petition for this in the Supreme Court on December 3 last year.
CCI had said – companies are trying to stop the investigation
While filing the petition in the Supreme Court, CCI had said that the companies are presenting challenges in different courts with the aim of stopping the investigation of the High Court.
CCI had requested the court to hear 23 complaints of vendors against Samsung, Vivo, Amazon and Flipkart.
Antitrust law on Amazon-Flipkart accused of violating
The matter is related to the CCI investigation in 2019. After investigation, the Competition Commission had alleged that Amazon and Flipkart gave more priority in the market to some selected sellers.
This disturbance of companies had an impact on India’s e-commerce market. The Investigative Unit of CCI found in the investigation that both the companies have violated the anti-trust law.
Additionally, collusion with smartphone manufacturers like Samsung and Vivo for special online launches was exposed.
The companies had denied any wrongdoing Amazon and Flipkart have been facing criticism from small retailers for many years regarding their business practices. They say that they have suffered losses due to the huge discounts and preferential treatment offered by the platform. Whereas Amazon and Flipkart have denied any kind of irregularities.

The government can issue summons to e-commerce platforms Amazon and Flipkart for questioning. Reuters quoted sources as saying that the government will issue summons to the officials of these companies as part of the investigation into violations of the Foreign Investment Law.
Recently, the Enforcement Directorate (ED) had raided some sellers associated with these companies. It is alleged that companies control the inventory (stock) through some selected sellers.
