Opinion: Appeal to the Constitution and attack on the federal structure! Where does the opposition want to take the country?

New Delhi. The opposition, which invokes the Constitution, is tearing apart the federal system of India. Questions are being raised on the federal investigation agencies. There have been attacks on the investigation agency team. There have been clashes between governors and state governments earlier too, but now cases have also started. Delhi CM Arvind Kejriwal is in Tihar jail in the liquor scam. He was arrested in March in the Delhi liquor scam. That means he has been running the government from jail for the last four months. Jharkhand CM has come out on bail after spending five months in jail. A minister of Jharkhand government, Alamgir Alam, resigned about a month after going to jail in the tender commission scam.

Bengal CM Mamata Banerjee is creating a different ruckus. She trusts her police, but she has an objection to the investigation of the CBI, which the common man trusts the most. In an attempt to prove the accused in the Sandeshkhali case innocent, the Bengal government went to the Supreme Court against the CBI investigation. In Mamata’s Bengal, ministers and MLAs have gone to jail on charges of selling teachers’ jobs. Former Bihar CM Lalu Prasad Yadav and Jharkhand’s Madhu Koda were also arrested. Recently in Jharkhand, a minister read a verse from the Quran without caring about tradition before taking the oath of office and secrecy. In non-NDA ruled states, the CM and the governor clash as if there is an old dispute over ancestral property between them. All this is possible only in our country!

Everybody gives a shout out to the constitution
It is surprising that all the leaders of the opposition parties seem to be most concerned about the Constitution. They chant the name of the Constitution like a sadhak chants a mantra. Now many opposition leaders carry a copy of the Constitution with them just like Vishwanath Pratap Singh used to carry an invisible list of names of people who took commission in the Bofors scam during election campaigns against the then PM Rajiv Gandhi. He would often say in his rallies that he has the names of all the people involved in the Bofors scam. While saying this, he would even take one hand to the pocket of his kurta. However, he never showed that list.

Opposition parties have a different approach
In a slightly different style from Vishwanath Pratap Singh, now the leaders of opposition parties display the copy of the Constitution in their meetings. If this is not enough, then they take oath of membership of the legislative house holding the Constitution. The constitution makers would not have imagined such a situation even in their dreams, otherwise they would have definitely made provisions for how to deal with those who question the constitutional arrangements. The most surprising thing is that the leaders of those parties are more concerned about the safety of the Constitution, whose leaders, while being with the Congress, did the most and most fatal tampering in 1975. It is also surprising that the leaders who were affected by that tampering are also the companions of the leaders who have taken up the flag of warning the public by announcing the danger to the Constitution.

Bengal has become a center for infiltrators
What did Mamata say earlier and what is her stand now? Everyone might remember Mamata Banerjee’s act in the Lok Sabha in 2005. There was a Left Front government in West Bengal at that time. Mamata was roaring in the Lok Sabha with a bundle of papers in her hand. She was telling that the Left Front government has given a free hand to Bangladeshi intruders in Bengal. The state government provides them ration cards and many such documents to prove that they are residents of Bengal. She even showed a list of some names that were registered as voters in Bangladesh and West Bengal simultaneously. She created a ruckus in the Lok Sabha for this. She even reached the Speaker’s seat. Now Mamata does not see any intruder in West Bengal. She is opposing the Citizenship Amendment Act (CAA). She is making a declaration not to implement it in West Bengal.

Demography is deteriorating in Jharkhand
The infiltration case came to light in Jharkhand in 2017, when there was a full majority BJP government led by Raghuvar Das. Now the figures given by the BJP people after meeting the Governor are really shocking and worrying. A PIL has also been filed in this regard in the Jharkhand High Court. The High Court had also recently sought an affidavit from all the Deputy Commissioners of the state with their opinion on identifying the infiltrators and sending them back. The affidavit was also submitted, but instead of the Deputy Commissioners, lower level officials gave an affidavit that infiltration may have happened in the past, but nothing like this has happened in recent years. The BJP is calling it an affidavit filed by incompetent officials under pressure from the state government. The BJP says that infiltration is still going on and if the situation remains the same, then by 2031 the tribals who have the highest population in Santhal Pargana will become a minority. BJP’s state spokesperson Pratul Shahdev says that in 1951 the number of tribals in Santhal Pargana was 44.67 percent. Today it has decreased to 28.11 percent. If this situation continues, tribals will become a minority in Santhal Pargana.

Questions on federal investigative agencies
Under the constitutional provisions, federal investigation agencies like Enforcement Directorate (ED) and CBI have been formed in the country. But the opposition parties do not trust them. The leaders of the opposition parties have repeatedly questioned their role. Questioning the impartiality of the federal investigation agencies, the opposition clan first went to the Supreme Court and now Mamata has reached the Supreme Court alone. It is a different matter that the opposition leaders did not get relief from the Supreme Court. There were attacks on the ED team in West Bengal. The mastermind of the attack kept dodging at first and when he was arrested, Mamata Banerjee does not trust the investigation of that case. She again went to the Supreme Court demanding that it be investigated by the state police. It is a good thing that the Supreme Court did not allow her to do so. On the contrary, Mamata’s intentions were questioned as to why she is so interested in saving the accused of crime. Now Mamata Banerjee has even refused to accept the criminal laws made by the central government. On the contrary, she has formed a commission to review it.

Disobeying a court order
Non-BJP state governments do not even obey the orders of the Supreme Court. Who is obeying the Supreme Court’s 50 percent limit on reservation! The Bengal government has filed a petition in the Supreme Court challenging the increase in the reservation limit. Bihar is preparing to go to the Supreme Court. Jharkhand is demanding direct inclusion in the Ninth Schedule. The governor had returned the bill related to reservation. Assembly elections are to be held in Jharkhand this year. It is possible that following Bengal’s footsteps, Jharkhand may also go to the Supreme Court against the governor by making the issue of returning the bill. Neighboring Bengal CM Mamata Banerjee has already shown the way to go to court against the governor.

Muslims are also unhappy with the court’s decision
Recently, the Supreme Court has given a decision on alimony to divorced women of the Muslim community. The Muslim community is refusing to accept the decision of the Supreme Court. Muslim organizations have called it a violation of Sharia law and have made it clear that they will not accept it. Earlier also, the Supreme Court had given a similar decision in the Shah Bano case, but the then Rajiv Gandhi government passed a law in the Parliament to nullify the Supreme Court’s decision. Congress also had to bear the brunt of this. The process of decline of Congress which started since then is continuing. Now the opposition has maintained silence on this.
