Yol had imposed emergency in the country on 3 December.
South Korea’s ousted President Yoon Suk-yeol has been arrested by the police from his residence on Wednesday. Yole is under criminal investigation to impose martial law in the country on December 3, 2024.
The decision of Martial Law (Emergency) was overturned by the country’s Parliament only after 3 hours. After this, on December 14, an impeachment motion was brought against Yol in the Parliament and he was removed from the post. The impeachment hearing was to be held in the Supreme Court on January 14, for which Yol was to appear in the court.
Yole did not appear in court yesterday. After this, an arrest warrant was issued against him this morning by the investigating agencies. The police who came to arrest him had to face heavy opposition on the spot. According to Al Jazeera report, more than 1000 policemen were deployed for the arrest.
Yol has been arrested and taken to appear before the Corruption Investigation Office. The first warrant was issued against him in this case.

Police entered the house using ladder
According to the report of news agency Yonhap, the guards engaged in the security of Yol had barricaded to stop the police. A large number of Yol supporters came to demonstrate outside the President’s residence. After this the police entered Yol’s house using the ladder.
Since yesterday, there was suspicion of Yol’s arrest due to his not appearing in the court. Pro-Yol protesters had started gathering outside his house since night. Ruling party MPs and Yol’s lawyers also tried to stop the police.
Earlier on January 3, the police had tried to arrest him in corruption related cases. However, then the police was stopped at the gate by 200 guards of the President. Thousands of protesters had gathered outside Yol’s house. After the uproar that lasted for about 6 hours, the police had to return empty handed.
There was also a clash between Yol’s supporters and the police.
The agency formed 4 years ago is investigating the President
According to the New York Times, Yole is the first president in the history of South Korea to be arrested for questioning on criminal charges. The name of the agency that arrested Yoon is Corruption Investigation Office (CIO).
CIO investigates corruption of big leaders and officials. Before the arrest of Yoon Suk Yeol, the same agency had issued a warrant for the arrest of the President. Even before the President’s arrest, two more agencies (State Prosecutors and the Police) had started investigating criminal cases against the President.
According to the report, the CIO and police will now investigate cases related to Yoon and state prosecutors will handle cases related to Yoon’s associates.
CIO was formed 4 years ago. The work which is now done by the CIO was earlier done by the State Prosecutors Office. But this agency is very infamous in this matter. Regarding CIO, Yoon’s lawyers say that this agency has no authority to investigate the President. According to experts, the CIO does not even have the authority to prosecute Yun. After completing its investigation, the CIO will have to hand over the case to the Prosecutors Office.
Only the State Prosecutors Office has the power to prosecute the President. The Prosecutors Office was considered loyal to Yun. But after the President’s decision to impose martial law, the Prosecutors Office turned against him. The Prosecutors Office has made several allegations against the President and his associates.
Yun is facing an impeachment trial in the Supreme Court. This will decide whether he will be reinstated or removed from the post. According to experts, the Supreme Court may give its decision in February.
There is tremendous public pressure on the court to take a quick and correct decision. No matter what the court rules on the indictment, the criminal investigation against Yoon will continue. But according to experts, if Yoon is reinstated to the post of President, the case against him will weaken.
Warrant will have to be taken from the court within 48 hours
After Yol’s arrest, the investigating agencies have 48 hours to interrogate him. After this, a warrant will have to be obtained from the court for his formal arrest. Yeol’s advisor Seok Dong-hyeon had said before his arrest that – Yoon Suk Yeol is ready for interrogation, provided the officers who came to arrest him return.
On the other hand, the court has 180 days from December 14 to hear the validity of the impeachment against Yol and the charges related to rebellion. If 6 out of 9 judges of the Supreme Court vote against Yol, he will be convicted.
If during this time Yole cannot be proven guilty or the impeachment is declared illegal, then Yole will once again become the President of South Korea.

Why did President Yole need to impose emergency?
There are a total of 300 seats in the Parliament of South Korea. In the elections held earlier this year, the public had given a huge mandate to the opposition party DPK. The ruling People Power got only 108 seats, while the opposition party DPK got 170 seats. Due to being in majority, the opposition DPK was interfering more in the functioning of the Presidential Government and they were not able to work as per their agenda.
President Yole won the election in 2022 by a slim margin. After this his popularity started declining. His image was also affected due to his wife being involved in many controversies. At present the popularity of the President is around 17%, which is the lowest among all the Presidents of the country.
To deal with all this, the President imposed martial law. He accused the DPK of sympathizing with North Korea and engaging in anti-national activities.
